Even if it was an evil act (it strikes me as being more an amoral act, which I don't think is an academic distinction), that doesn't necessarily make him a complete black hat, any more than Claire trying to kill Brody makes her a black hat. Most of the rest of the time he's seemed to be gathering information more than anything else -- he's had the oppotunity to kill about half the heroes so far, and hasn't. None of this puts him on the side of the angels, but I suspect he's going to be more a representative of "the world that hates and fears them" than an evil overlord.
